As the UCC debate continues, let’s take a look at those that are supporting it

With Uttarakhand preparing to implement the legislation and the legislation Commission expected to publish a report after the process of public consultations concludes on July 13, the argument over the Uniform Civil Code (UCC) has gained speed.

Officials from the law ministry reportedly said that they would not move in that direction until they had read the 22nd Law Commission’s findings.

Despite the fact that numerous Congress leaders have questioned the timeliness of the Uniform Civil Code’s implementation throughout the nation and noted that it may not be supported by tribal groups and the northeast, other members of the Opposition have endorsed the measure.<img decoding=”async” class=”alignnone wp-image-59634″ src=”https://www.theindiaprint.com/wp-content/uploads/2023/07/www.theindiaprint.com-as-the-ucc-debate-continues-lets-take-a-look-at-those-that-are-supporting-it-uniform-civil-code-750×433.jpg” alt=”” width=”1477″ height=”853″ srcset=”https://www.theindiaprint.com/wp-content/uploads/2023/07/www.theindiaprint.com-as-the-ucc-debate-continues-lets-take-a-look-at-those-that-are-supporting-it-uniform-civil-code-750×433.jpg 750w, https://www.theindiaprint.com/wp-content/uploads/2023/07/www.theindiaprint.com-as-the-ucc-debate-continues-lets-take-a-look-at-those-that-are-supporting-it-uniform-civil-code-768×443.jpg 768w, https://www.theindiaprint.com/wp-content/uploads/2023/07/www.theindiaprint.com-as-the-ucc-debate-continues-lets-take-a-look-at-those-that-are-supporting-it-uniform-civil-code-150×87.jpg 150w, https://www.theindiaprint.com/wp-content/uploads/2023/07/www.theindiaprint.com-as-the-ucc-debate-continues-lets-take-a-look-at-those-that-are-supporting-it-uniform-civil-code.jpg 842w” sizes=”(max-width: 1477px) 100vw, 1477px” />

The late Himachal Pradesh Chief Minister’s son, Vikramaditya Singh, said that Congress represents all sections of India and upholds the principle of harmony in diversity. Therefore, no one should believe that the legislation is against them before enacting it. BJP needs to include everyone. Vikramaditya had said, “Whenever UCC will come, we will support it.”

Mayawati, the leader of the Bahujan Samaj Party, said she was not against UCC but dissatisfied with the way the BJP is politicking the matter. “Our party (the BSP) is not opposed to the adoption of the Uniform Civil Code, but we oppose the manner in which the BJP is attempting to do it. Politicizing this matter and imposing UCC throughout the nation is wrong. The UCC will promote communal peace while strengthening the nation rather than weakening it.

Arif Mohammed Khan, the governor of Kerala, said, “My opinion on the UCC is the opinion of the Constitution. How can anybody be against the idea of having a uniform code for the whole nation? You are demonstrating your lack of trust in the Constitution if you oppose it.

In the Shah Bano case, the Supreme Court said that “a common civil code will help the cause of national integration by removing disparate loyalties to law which have conflicting ideologies.”

There were no elections when the prime minister made decisions for the welfare of the populace, such as providing free meals to 80 crore people and gas connections to 9 crore people, according to Minister of State for Health and Family Welfare SP Singh Baghel. This was done only with Indian nationals’ interests in mind. The wellbeing of the underprivileged and the country as a whole are the main interests of the government, he said.

Mahesh Jethmalani, an attorney for the Supreme Court, said, “I am a firm supporter of a Uniform Civil Code. Despite the fact that our nation is varied, all faiths must concur on a standard family law… The idea that it is against minorities is absurd. Congressmen who are against the UCC should read the discussion in the constituent assembly.

Harish Salve, a senior counsel, said, “I have been a supporter of the establishment of UCC. Does it have an impact on anyone’s faith? No, it provides you the option to choose whether to abide by secular law or not.You may decide which legislation will apply to you. Why would Muslims suffer from it? It will offer a Muslim woman the option to divorce her husband, which is against their personal law.

According to the book “Bharatiya Samvidhan: Ankahi Kahani,” Pandit Jawaharlal Nehru condemned UCC. Meenu Masani, a freedom warrior and the mayor of Mumbai, was the one who originally suggested the creation of the UCC in front of the legislature in 1947. However, Nehru rejected it. Parsi Meenu Masani backed the UCC and said, “I am speaking as an Indian.”

WHO ARE UCC?

It is a suggestion that all religious organizations would be subject to the same legislation regarding marriage, divorce, inheritance, adoption, and maintenance. For all of its residents, India has a single, consistent “criminal code,” yet it lacks a single, universal civil law.

Article 44 of Part IV of the Constitution, which provides Directive Principles of State Policy that cannot be imposed upon the state but serve as guiding principles, makes reference to the UCC.

UCC seeks to equalize all communities under a single, overarching rule since certain aspects of personal law are seen as being inequitable.
